Statement of Central Election Commission on the Facts of Administrative Violation
On May 19, Natalia Begashvili, Chairperson of Gurjaani District Election Commission drew up the protocol on administrative violation and sent it to the Court. The case concerns to the participation of Besarion Todashvili, commission member at №5 election precinct of Gurjaani DEC in pre-election agitation in favor of the coalition “Georgian Dream”. A hearing on the mentioned case was conducted at Gurjaani DEC. Interested stakeholders were also attended the meeting.

As an enquiry revealed, participation of Besarion Todashvili in pre-election agitation is proved by the video materials published on the official webpage of news agency “Information Center of Kakheti”. Participation of the election commission member in pre-election agitation is prohibited in accordance with subparagraph “a”, paragraph 4, article 45 of Election Code of Georgia. The violation envisages relevant sanction by the article 79, Election Code of Georgia.

On May 16, 2014 protocol on administrative violation drawn up by Mindia Iukuridze, Chairperson of Akhmeta District Election Commission was sent to the Court. The case concerns involvement of Mamuka Kholegashvili, high official at Akhmeta local authority in pre-election agitation in favor of the coalition “Georgian Dream”. Akhmeta DEC studied the materials submitted by the political union “United National Movement” (on May 3, 2013 the application was submitted to the CEC, which was sent to Akhmeta DEC for further response). As an enquiry revealed, Mamuka Kholegashvili participated in pre-election agitation during working hours, while directly carrying out his official duties, which is prohibited by the subparagraph “c”, paragraph 1, article 49, Election Code of Georgia. The violation envisages sanction prescribed by the article 88 of the Election Code of Georgia.
